A nova lei do divórcio: avanço social ou desvalorização da família?

Abstract

O presente trabalho tratará a respeito da Lei n.º 11.441/07, a chamada “nova Lei do divórcio”, abordando os aspectos históricos da evolução da família e seu conceito na evolução da sociedade brasileira além de apresentar a evolução do conceito de dissolução do vínculo conjugal no país bem como no direito comparado. A introdução do divórcio no Brasil se deu de forma lenta e gradual, gerando críticas e opiniões diferenciadas a respeito dos benefícios de sua introdução. Muitos pensavam que apresentar a possibilidade do divórcio causaria completa destruição da instituição familiar. Com o passar do tempo, diversas legislações trataram a respeito do divórcio e facilitaram sua obtenção, permitindo até mesmo a contração de novas núpcias. A nova lei do divórcio vem trazer a possibilidade de obtenção do divórcio, separação, partilhas e inventários através da via extrajudicial. A questão que resta é a seguinte: Essa facilitação trazida pela nova Lei representa um avanço ou uma afronta à instituição familiar?

The present paper is going to treat about the Law n.º 11441/07, the one called “The new divorce law”, approaching the historic aspects of the family evolution and its concept in the evolution of the Brazilian society besides presenting the evolution of the concept of dissolution of the conjugal bond in the country such as in the comparative jurisprudence. The introduction of the divorce in Brazil happened in a slow and gradual form, generating criticism and different opinions about the benefits of its introduction. Many people believed that presenting the possibility of the divorce would cause the complete destruction of the family institution. Through the time, many laws have treated about the divorce and facilitated its attainment, allowing even the contraction of new nuptials. The new divorce law brings the possibility to obtain the divorce, separation, inventories and allotment through the extrajudicial way. The question is the following: Does this facilitation brought by the new law represents an advance or depreciation of the family institution?
