As mudanças da lei 11.232/05 no processo de execução de títulos judiciais

Abstract

O presente trabalho tem como escopo analisar as principais mudanças introduzidas pela Lei 11.232/05 no processo de execução de títulos judiciais. Tratar-se-á dos antecedentes da execução, desde Roma antiga até os dias atuais. Ver-se-á a sentença e o seu novel conceito, fazendo algumas considerações sobre a resolução do processo. No terceiro capitulo, falar-se-á da liquidação de sentença, sua natureza, quem são os legitimados para requerer a liquidação, e outros assuntos correlatos. No último capítulo, terce-a sobre o cumprimento da sentença que, para alguns doutrinadores, este é o gargalo da execução; será o assunto mais tratado neste singelo trabalho, uma vez que, é através do cumprimento da sentença que se realizará a execução sincrética. Desta forma, busca-se o legislador a efetividade jurisdicional. Por fim, este presente trabalho não esgota todo o assunto no que diz respeito ao tema.
