O nexo de causalidade na responsabilidade civil por abandono afetivo

Abstract

Pesquisa do nexo causal na indenização por abandono afetivo. A assistência material e afetiva é dever dos pais e direito do filho. Ela resulta da conjunção dos princípios constitucionais – da dignidade da pessoa humana, da afetividade, da igualdade entre os filhos e do melhor interesse da criança – com os direitos de sustento, de assistência moral e de educação. O descumprimento injustificado da assistência material é hipótese de prisão civil permitida pela Constituição Federal de 1988. A omissão paterna no que tange à assistência moral viola o direito a honra e a imagem do filho, gera danos e caracteriza o abandono afetivo. Defende-se, então, que esses danos estão sujeitos à reparação. A responsabilidade civil faz nascer ao pai a obrigação de indenizá-los ao filho ofendido. Conforme a doutrina, a conduta comissiva ou omissiva, o dano e o liame causal entre ambos, são pressupostos para o surgimento do dever de indenizar. Assim, o nexo de causalidade como elemento indissociável da teoria da responsabilidade civil por abandono afetivo na relação paterno-filial é o objeto de estudo do presente trabalho, em razão da dificuldade em estabelecer o liame causal entre o abandono e o dano vivenciado.

Research on casual connection in the indemnification of affective abandonment. The material and the affective support are the parents’ duty and a child’s right. It results from the conjunction between the constitutional principles – the human being dignity, affectivity, equality among children and the child’s best benefit – and the sustenance rights, moral support and education. The non observation of the material support without justifying may leads to civil prison permitted by the 1988 Federal Constitution. The paternal omission referring to the moral support violates the right to honor and the child image, it generates damages and it characterizes the affective abandonment. It’s defended, in this case, that those damages are subject to reparation. The civil responsibility competes to the parents the obligation to indemnify to the offended child. According to the doctrine, the comissive or omissive conduct, the damage and the causal connection between both, are presuppositions to the arisement of the duty to indemnify. Thus, the connection of causality as indissociable element of the civil responsibility theory for affective abandonment in the parent-child relation is the study object of this work, by reason of the difficulty to establish the causal connection between the abandonment and the experienced damage.
