Controle judicial dos atos administrativos

Abstract

No presente trabalho discute-se a possibilidade do Poder judiciário exercer um controle sobre o ato administrativo. Para isso foram desenvolvidos quatro capítulos. Primeiramente verifica-se o ato administrativo em si através de um estudo sobre a sua estrutura composta por conceito, requisitos e atributos. O segundo capítulo trata das diferenças entre a revogação e a anulação do ato administrativo e todas as nuances destes institutos. O terceiro capítulo trata das modalidades de controle da administração pública. Por último, o quarto capítulo vai tratar do tema específico deste trabalho: o controle judicial dos atos administrativos. Neste capítulo comparam-se os entendimentos da doutrina clássica e da moderna quanto à possibilidade do exame de mérito do ato administrativo pelo Judiciário.

In the presented work it is discussed the possibility of an "administrative act" control by the Judiciary. For this purpose there are four chapters. First, the "administrative act" is verified thoroughly (concept, requisites and attributes). The second chapter refers to the difference between "revogação" and "annulment" of the "administrative act" and its contents. In the third chapter it is discussed the fields of public administration control. Finally, the fourth chapter is developed the main subject of the work: judicial control of the "administrative acts" - the classic and modern doctrines comparisons regarding the possibility of "administrative act honor exam" by the Judiciary.
