Abuso do direito nas relações obrigacionais

Abstract

Este trabalho trata sobre a incidência da teoria do abuso do direito no âmbito das relações obrigacionais. A temática analisa os fundamentos axiológicos e os limites impostos as diversas posições jurídicas contidas no Código Civil de 2002. Foi necessário considerar a comparação entre o artigo 187 da legislação civil brasileira e o artigo 334 do Código Civil Português de 1966. Salienta que a teoria do ato abusivo foi analisada em seus aspectos sociais e jurídicos, no que condiciona da licitude ao exercício das posições jurídicas. Destaca-se que o exercício das diversas posições jurídicas subjetivas, em especial as relações obrigacionais, manifesta diante dos limites traçados pelo sistema jurídico contemporâneo à liberdade contratual.

This work treats on the incidence of the theory of the abuse of the right in the scope of the obligatory relations. The thematic one analyzes the axiológicos beddings and the limits taxes the diverse contained legal positions in the Civil Code of 2002. It was necessary to consider the comparison enters article 187 of Brazilian civil the legislation and article 334 of the Portuguese Civil Code of 1966. Salient that the theory of the abusive act was analyzed in its social and legal aspects, mainly, in what it says respect to the principles of the social or economic function, of the good-faith and the good customs that had limited the abusive exercise of the right. Moreover, it conditions the legality of the exercise of such legal positions the respect of the limits taxes for the good-faith, the good customs and the economic and social end. It is distinguished that the exercise of the diverse subjective legal positions, in special the obligatory relations, manifest ahead of the limits tracings for the legal system contemporary to the contractual freedom.
