Redução da maioridade penal: um debate sobre mídia televisiva, direito e serviço social

Abstract

Brazil is experiencing a serious crisis of violence in the whole country. The high rate of violence, social and economic inequality reflects in the poorest section of society, ironically, having their children and adolescents being blamed for the chaos that the country lives. The Television Media is one of the main sectors that blame the poor children and adolescents for the phenomenon of violence, together of moralistic sectors of the Brazilian political-judicial system. The reduction of criminal liability from eighteen to sixteen is an act that does not follow the principles of the Law and the Federal Constitution of 1988, representing the setback in years of struggles in the defense and formulation of human rights in Brazil and affecting the performance and expectations of the Social Service and other categories. The strict and effective non-compliance of socio-educational measures foreseen in the law influences in a real way the non-rehabilitation of the adolescent offender, contributing to the construction of a criminal adult. The Social Worker in his ethical-political function must articulate methods and actions that make this constitutional illegality unfeasible, since the approval of the reduction of the criminal majority represents a serious crime against socio-educational measures and their materialization. Through a bibliographical research of articles, books, laws and official statistical data, it has been proved that the debate on the reduction of the majority, inflamed by the Television Media, is an act without legal and moral validity. Faced with the complex reality of violence in childhood and adolescence, the solution is to strengthen and reduce bureaucracy of socio-educational measures, not to create more punitive laws and to increase the prison population of Brazil.
