Cooperação jurídica internacional entre Brasil-Itália no caso Cesare Battisti (2007 - 2019)

Abstract

The purpose of this paper is to analyze the Cesare Battisti Case, presenting with this analysis, how was justified the decision of the Brazilian government in its judgment and the granting of political refuge to Battisti, as well as how this decision can affect the international law between nations in the diplomatic relationship between Brazil and Italy. It seeks to explain how Battisti was granted political refugee status when he committed what is considered a common crime in Italy, and was convicted of four murders in his home country, thus disregarding the Foreigner Statute. In addition to clarifying how the extradition process occurs by presenting the basic concepts governing International Relations and that allows countries to realize this institute. Thus, highlighting the operation of international law, the foundation of sovereignty and international treaties, political refugee status and international legal cooperation. Using the bibliographic methodology with secondary sources, articulating a case study to expose the events during the case, with the insertion of the work of authors such as Francisco Rezek, Amaral Junior, Carina Soares and Cezar Bitencourt, etc.
