| Summary: | O presente trabalho busca discutir o reconhecimento da paternidade socioafetiva post mortem. Com a promulgação da Constituição Federal de 1988 e o Código Civil de 2002, passou-se a adotar tratamento igualitário entre os filhos, independentemente de sua procedência, dando aos laços afetivos importância equivalente aos consanguíneos. Assim, pretende-se demonstrar o possível reconhecimento da paternidade socioafetiva mesmo após o falecimento dos pais afetivos sem o devido perfilhamento enquanto vivos. |
| Abstract: | This text seeks analyse the post mortem socioaffective paternity. With the Federal Constitution promulgation in 1988 and the Civil Code in 2002, start equal treatment among the children, no matter how they came, equivalent affective bonds of blood children. That way craves possible the socioaffective paternity even after the death of the affective relatives without the recognition of the child while alive. |
