| Summary: | Este artigo tem como objetivo demonstrar o que são danos extrapatrimoniais e a aplicação destes de acordo com a nova sistemática introduzida na seara trabalhista pela Lei 13.467/2017; Além disso, apresenta uma análise de como se dava a indenização por danos extrapatrimoniais antes da vigência da Lei. Vislumbra também demonstrar a inconstitucionalidade do art. 223-G, § 1°, da CLT, que traz parâmetros para a fixação da indenização tendo por base o salário contratual do ofendido, ante a violação aos princípios constitucionais da reparação integral, da dignidade da pessoa humana e da isonomia. Por fim, apresenta-se o posicionamento do Supremo Tribunal Federal-STF, quanto à tarifação das indenizações por danos extrapatrimoniais. |
| Abstract: | This article aims to demonstrate what are non-material damages and its application according to the new systematic introduced in the labor court by law 13.467/2017, making an analysis of how compensation was given for non-material damages before the validity of the Law. Also seeking to demonstrate the unconstitutionality of art. 223-G, § 1°, da CLT, which brings parameters for the fixing of compensation, based on the contractual salary of the offended, in the face of violation of the constitutional principles of complete redress, the dignity of the human person and isonomy. Finally, the position of the Supreme Court – STF, regarding the quantification of non-material damages. |
