| Title: | Princípio da insignificância: a aplicação do princípio da insignificância pelo delegado de polícia |

| Summary: | O presente trabalho se propõe a apresentar o Princípio da insignificância através de pesquisas bibliográficas e jurisprudenciais, na finalidade de entender a linha de pensamento dos colaboradores do direito. Além do mais, necessário se fez o estudo da origem do princípio em comento a fim de entender a importância que este tomou no cotidiano forense, sendo um dos meios mais utilizados pelo poder judiciário para afastar crimes desinteressantes para o direito penal. A partir daí buscou-se trazer para a discussão o papel da autoridade policial frente a um crime bagatelar na intenção de verificar a possibilidade de sua aplicação ainda na fase investigativa, para tanto mostrou-se relevante analisar os limites de atuação do delegado de polícia em consonância com a ausência do juízo de ponderação que é reservado ao magistrado. Assim, foi possível chegar a uma conclusão acerca da possibilidade ou não de aplicação do princípio da bagatela pela autoridade policial. |
| Abstract: | The present work proposes to present the Principle of insignificance through bibliographic and jurisprudential research, in order to understand the line of thought of the collaborators of law. In addition, it was necessary to study the origin of the principle under review in order to understand the importance that it has taken inf forensic daily life, being one of the most used means by the judiciary to remove uninteresting crimes to criminal law. From then on, it was sought to bring to the discussion the role of the police authority in the face of na offense in the intent of verifying the possibility of its application still in the investigative phase, for that it was relevant to analyze the limits of performance of the police delegate in line with the absence of the weighting judgment that is reserved for the magistrate. Thus, it was possible to reach a conclusion about the possibility or not of application of the trifle principle by the police authority. |
