| Summary: | O presente artigo apresenta a constelação sistêmica como um instrumento preparatório na contribuição para a resolução de conflitos no Poder Judiciário, desenvolvidas pelas técnicas de conciliação e mediação como forma consensual, na qual as partes interessadas têm a capacidade de decidir livremente sobre determinado litígio, incluindo diversos benefícios como procedimento célere para diminuição do desgaste físico, psicológico e emocional dos conflitantes, além do menor custo financeiro, entre outros. Diante das propostas de utilização dos meios alternativos de resolução de conflitos pelo Poder Judiciário com a Resolução nº 125/10 do Conselho Nacional de Justiça, a Lei de mediação e o Código de Processo Civil de 2015, surgiu a constelação familiar, que se trata de uma técnica psicoterapêutica desenvolvida por Bert Hellinger com o intuito de reduzir as demandas, que por diversas vezes têm sido repetitivas no Judiciário. Por fim, o artigo demonstra a importância do direito sistêmico de Sami Storch em analisar o litígio com uma perspectiva mais humanizada. |
| Abstract: | This article presents the systemic constellation as a preparatory instrument in the contribution to the resolution of conflicts in the Judiciary, developed by the techniques of conciliation and mediation as a consensual form, in which the interested parties have the ability to freely decide on a certain dispute, including several benefits such as a speedy procedure to reduce the physical, psychological and emotional wear and tear of the conflicting ones, in addition to the lower financial cost, among others. In view of the proposals for the use of alternative means of conflict resolution by the Judiciary with Resolution No. 125/10 of the National Council of Justice, the Mediation Law and the Civil Procedure Code of 2015, the family constellation emerged, which is about a psychotherapeutic technique developed by Bert Hellinger in order to reduce the demands, which for several times have been repetitive in the judiciary. Finally, the article demonstrates the importance of Sami Storch's systemic right to analyze litigation with a more humane perspective. |
