Teoria do desvio produtivo, em prol da defesa do consumidor

Abstract

The present article is the result of a quantitative research, which used materials already elaborated as legal articles, monographs, dissertations and legal journals that approach an analysis of the theory of productive deviation and that allows the consumer to search for his rights, showing the right of indemnities and repairing new damage that arises in relation to lost vital time. This work contains a study that will analyze the effects of consumer law and the theory of productive deviation, in addition to identify whether the consumer can be compensated for the damages suffered and for the time wasted. It will apply the concept, characteristics and the emergence of consumer law; it will distinguish the types of protection that will ensure the consumer, apply civil liability under the Consumer Protection Code and investigate the temporal damage, which causes the loss of the useful time of the consumer. In addition, it presents a methodological analysis in a manner that the research will start from the existing theories to confirm the hypotheses expressed, being the study objective open and broad, which will allow find answers to the formulated problem and will produce new knowledge. Finally, the initial concepts of consumer law and the theory of productive diversion, civil liability combined with the repair of damages and their recognition of the new temporal damage will be examined. It will deal with consumer protection in court, along with the evolution of the theory of productive deviation in the legal system and the proof of the insertion of innovative thinking in the jurisprudence.
