Regulamentação do lobby: uma perspectiva comparada entre Brasil e Estados Unidos

Abstract

The main objective of this paper is to outline the main challenges and opportunities related to the implementation of lobbying regulations in Brazil, based on a comparative study between the consolidated model in the United States and Brazilian attempts to regulate the sector. In order to achieve this objective, the context and regulatory standards in force in the USA were explored, including the debates in Congress and the delimitations that characterize the activity in the American panorama. In addition, the characteristics, scenarios, legislative proposals and difficulties faced by Brazil in trying to establish a regulatory system for the field were analyzed, with a focus on promoting greater transparency and breaking the association between lobbying and corruption. The research also included interviews with two experts in the field of Institutional and Government Relations: Antônio Marcos Umbelino Lôbo, CEO of Umbelino Lôbo Assessoria e Consultoria, and Creomar de Souza, CEO of Dharma Political Risk and Strategy. The perspectives shared by these professionals provided a significant basis for the analysis of the Brazilian context, enriching the understanding of the particularities and challenges faced in the process of regulating lobbying in the country. From the comparative analysis between the two scenarios, it was possible to identify the main aspects that need to be considered in order to build effective regulation in Brazil, as well as the potential consequences of its implementation. The comparative analysis revealed that it is not feasible for Brazil to adopt regulations based directly on the US model, due to the cultural, institutional and structural differences between the two countries. Instead, it highlighted the need for regulations adapted to the Brazilian context, which take into account local particularities and seek to avoid implementing excessive bureaucracy, at the risk of making adherence to the system unfeasible. The study also highlighted the potential benefits that regulating lobbying could bring to Brazil, including improving the country's international image in the fight against corruption and strengthening the conditions for joining the Organization for Economic Cooperation and Development (OECD). Finally, this work reinforces not only the relevance of regulating lobbying, but also provides input for future debates and initiatives, considering both the benefits and the challenges associated with the theme.
