| Summary: | O presente trabalho tem como objetivo conhecer e analisar a aplicação do Controle de constitucionalidade pelo Tribunal de Contas da União no ordenamento jurídico brasileiro, analisando, para tanto, a evolução e o revisionismo de atribuições relacionadas ao tema pelo Supremo Tribunal Federal e pela própria Corte de Contas, com enfoque na análise de sua evolução histórica, partindo de exame do tema frente a Constituição Federal de 1946, com a redação da Súmula 347/STF, e findando na análise da recepção desta jurisprudência pela vigente Constituição Federal de 1988, com o exame do tema pelo STF em sede de Mandado de Segurança n. 35.410/DF, de relatoria do Ministro Alexandre de Moraes. |
| Abstract: | The present study aims to understand and analyze the application of Constitutional Control by the Federal Court of Accounts in the Brazilian legal system. In order to do so, it examines the evolution and revision of responsibilities related to this topic by the Supreme Court and the Court of Accounts, with a focus on the analysis of its historical development. This analysis begins with an examination of the topic under the Federal Constitution of 1946, with the wording of Summary 347/STF, and ends with an analysis of the reception of this jurisprudence by the current Federal Constitution of 1988, through the examination of the judgment by the Supreme Court in the case of Mandado de Segurança n. 35,410/DF, reported by Minister Alexandre de Moraes. |
