| Summary: | O presente trabalho tem por tema “A concessão da rodovia federal BR-040: avanço ou retrocesso?” e pretende, portanto, analisar as condições das rodovias federais que estão sob os cuidados do Estado, e aquelas que foram concedidas á iniciativa privada, em especial examinando as peculiaridades da concessão da rodovia BR-040. O objetivo deste trabalho é analisar se a concessão das rodovias é algo positivo ou não para os usuários destas estradas, evidenciando se há mais segurança ao trafegar, se a pavimentação e sinalização condizem com a obrigação do Estado em cuidar para que a população transite tranquilamente, podendo ter a confiança de que chegará ao destino sem maiores problemas. Esta monografia se deu à luz da doutrina, das Leis 8.666/93 e 8.987/95, além de tese de mestrado e relatório da Confederação Nacional do Transporte acerca das rodovias em 2014. Após o estudo do instituto da concessão, do contrato e dos gráficos, pretende-se constatar os benefícios e malefícios que as concessões trazem, refletindo consequentemente no usuário da rodovia e até mesmo nos custos gerados pelos acidentes e mortes. |
| Abstract: | This work has as its theme “The concession of the federal highway BR-040: improvement or recess?”, and aims, therefore, to analyze in which conditions are the federal highways that are under care of the State and those that were granted to private enterprise, particularly in examining the peculiarities of the concession of the highway BR-040. The goal of this work is to realize if the concession of the patchways is something positive or not for the users of those roads, evidencing if there is more safety in traffic, if the paving and signaling relates to the obligation of the State in caring so that the population can traffic undisturbedly, having confidence that they will arrive to their destiny without trouble. This monograph was made by the light of the doctrine, of the Laws n. 8666/1993 and 8.987/1995, as well of a master’s degree thesis and the report of the National Confederation of Transport regarding the highways in 2014. After the study of the institute of concession, the contract and graphics, it is intended to find the benefits that are brought by the concessions, consequently reflecting on the user of the highway and even on the costs generated by the accidents and deaths. |
