| Summary: | O presente opúsculo tem como objetivo estudar a medida de segurança em seus fundamentos teóricos, avaliando sua justificação dentro do poder de punir, entendendo os princípios normativos que legitimam e limitam as medidas de segurança no atual sistema penal. Sobre o tema será abordado sua previsão no atual sistema político criminal, com destaque no que dispõe o Código Penal – CP; Lei De Execução Penal – LEP; Lei Da Reforma Psiquiátrica e, atual jurisprudência. Sendo verificada a execução da medida de segurança e sua operacionalização, levando em consideração o ponto de vista Constitucional em relação à proibição das penas de caráter perpétuo, a prevalência da dignidade da pessoa humana, o princípio da isonomia e proporcionalidade. |
| Abstract: | This booklet aims to study the safety measure in its theoretical foundations, assessing its justification within the power to punish, understanding the normative principles that legitimize and limit security measures in the current criminal justice system. On the subject will be approached their forecast in the current criminal political system, which features prominently in the Criminal Code - CP; In Criminal Law Enforcement - LEP; From the Psychiatric Reform Law, and current case law. Being verified implementation of security measures and their implementation, taking into account the point of view regarding the Constitutional prohibition of custodial perpetuity, the prevalence of human dignity, the principle of equality and proportionality. |
