A possibilidade de dano moral em virtude de relações extraconjugais

Abstract

The work is titled “THE POSSIBILITY OF MORAL DAMAGE AS A RESULT OF EXTRAMARITAL RELATIONS”, and tries to argue about the financial consequences resulting from the failure of conjugal duties, more specifically, the duty of mutual fidelity, provided the Brazilian Civil Code. Addresses the importance of family in social relations, the formation of the marital partnership, the institute of civil liability, the types of damage and, ultimately, the chances of compensation in case of breach of marital duties. Joins three Brazilian jurisprudences of different courts on the subject, trying to demonstrate the legal grounds for granting and valuation of the damage incurred in the cases.
