Síndrome de alienação parental e a responsabilidade civil do alienador

Abstract

In the face of family conflict sometimes resulting from the breakdown of marital relations, there arises a problem systematically discussed today, the Parental Alienation Syndrome. This is characterized by the behavior of one parent, usually the one who has custody of the children, which begins a moral deconstruction process of the other parent before the child. Thus, alienating implants in the subconscious a negative image of the son of the alienated parent, sharing feelings associated with hatred, bitterness and abandonment experienced in divorce proceedings. Given the above, the judiciary has key role in the intervention process within the family relationship, so as to protect the best interests of the minor. Thus, this study aims to analyze the civil liability of the alienating parent would be a means to curb the practice of parental alienation or just damage the interface of the relationship between the parents.
