| Summary: | A presente monografia tem por tema a audiência de custódia e sua efetivação no ordenamento jurídico pátrio, tratando de suas características e a necessidade de sua implementação. É objetivo do presente estudo, trazer explanações acerca deste instituto, visando, inclusive, adequar o processo penal brasileiro às normas da Convenção Americana de Direitos Humanos. Este trabalho utilizará o método fenomenológico com objetivo explicativo, cuja finalidade é proporcionar maior familiaridade com a temática eleita, por meio de levantamento bibliográfico, doutrinário e jurisprudencial, assim como, a legislação pertinente. O trabalho está didaticamente dividido em três capítulos, contendo um estudo acerca das prisões cautelares, dos Direitos Humanos e da audiência de custódia em nosso território. Traz também a opinião dos profissionais que atuam nesta área jurídica, e ainda algumas estatísticas que elucidam o assunto. |
| Abstract: | This monograph is to issue a custody hearing and its implementation in the national legal system, dealing with its characteristics and the need for its implementation. It is aim of this study to bring explanations about this institute, aiming even suit the Brazilian criminal procedure norms of the American Convention on Human Rights. This work uses the phenomenological method with explanatory goal whose purpose is to provide greater familiarity with the chosen theme, through literature, doctrinal and jurisprudential as well as the relevant legislation. The work is didactically divided into three chapters, containing a study on the precautionary arrests, Human Rights and the custody hearing in our territory. It brings also the opinion of professionals working in this legal area and also some statistics that shed light on the subject. |
