Abstract

The topic Civil Liability for emotional abandonment appeared before the many controversies arose its applicability in the Family field, especially in view of the recurring failure of the duties of assistance, care, diligence and company of parent (s) in relation to their offspring. This omission, in theory, could cause very serious damage to the psychological development of children. Makes an overview about civil liability through a brief history and objective concepts, especially later, the basic principles of family law applicable to the study. With this, the aim is to facilitate the understanding of the discussions arising from this theme in the doctrines and Patriotic Courts as well as the reasons that gave rise to the creation of a bill with a view to specifically regulate this institute, establishing sanctions on those who fail to provid assistance to his son. This demonstrates the delicacy and importance of the subject on a framework that unfortunately is repeated in the Brazilian daily.
