A mitigação dos direitos fundamentais à luz do Congresso Nacional

Abstract

This study aims to analyze the proceeding in bills in Congress that show real threats to fundamental rights and the principles of the democratic rule of law. Therefore, there will be a study of fundamental rights in all its specificities, such as features, efficiency and hermeneutics. It will be demonstrated linking of the legislature to Fundamental Rights, in active and negative perspectives. Finally, bills are presented considered unconstitutional that are before and designed to contain and even extinguish me fundamental rights already conquered, in the Federal Constitution, such as the bill entitled the Family Statute that limits the concept of family only heterosexual couples, excluding families formed by homosexual couples. The scope of this paper is to demonstrate the current situation in the National Congress, where the congressmen, elected democratically by the people, which should ensure the effective provision of rights, end up disrespecting the constitution by submitting bills that adversely affect fundamental rights.
