Prescrição nos crimes sexuais contra crianças e adolescentes e a alteração trazida pela Lei 12.650/12

Abstract

This work has as object of study the legislative change regarding sex crimes committed against children and adolescents, where the legislator by means of Ordinary Law 12,650/12 increased the time of prescription for those who practice abuse against minors. It is known that in the country, the question of sexual violence has always been cause for social concern. Stands out historical facts on the international scene regarding the protection of children and adolescents and of historic legal national the this protection, as well as the guiding principles that protect the child and the adolescent. The Federal Constitution ensures rights to protection especially to children and adolescents, arguing that "the law shall punish severely the abuse, violence, sexual exploitation of children and adolescents". The Statute of the child and adolescent Law 8,069/90 established the principle of protection maximum to children and adolescents. Occurs, however, that crime in the country persists, being necessary that the famous people began to denounce in the media the abuses they suffered in childhood, so , the National Congress has taken measures and approved a new law that increases the deadline of prescription for the criminal who commits these crimes.
