| Summary: | A Lei 12.654/2012 introduziu significativa mudança na legislação pátria, que é a criação de um banco de dados genéticos que tem como precípua função a identificação criminal através do DNA. Sendo vista como importante ferramenta para a elucidação de crimes praticados dolosamente, com violência de natureza grave contra a pessoa, ou por qualquer dos crimes previstos no art.1º da Lei nº 8.072/1991, onde os acusados serão submetidos, obrigatoriamente, à identificação do perfil genético, mediante extração de DNA - ácido desoxirribonucleico. Contudo, a lei traz significativa discussão sobre a nova modalidade de identificação criminal através do DNA. |
| Abstract: | Law 12.654/2012 introduced significant changes in Brazilian legislation, which is creating a genetic database that has the primary function to criminal identification through DNA. Being seen as an important tool for the elucidation of crimes committed intentionally, the serious nature with violence against the person, or by any of the offenses set forth in article 1º of Law 8.072/1991, where the accused will be subjected necessarily to the identification of genetic profile by extracting DNA - deoxyribonucleic acid. However, the law brings significant discussion about the new type of criminal identification through DNA. |
