| Summary: | O presente trabalho trata dos direitos e deveres advindos do reconhecimento da paternidade, versa sobre os efeitos sucessórios que nascem do reconhecimento da paternidade e sobre o tratamento jurídico dispensado para a pessoa dos filhos. A problemática do tema está no tratamento do filho afetivo frente aos filhos biológicos. O Código Civil de 1916 já resguardava o reconhecimento da paternidade, porém com restrições. Quando, porém, passa a viger, a Constituição Federal de 1988, novos princípios passaram a ser diretrizes para a criação de leis que melhor se adequassem às tendências sociais, passa então a perceber o afeto como base nas relações familiares, Assim, para possibilitar decisões adequadas à realidade, necessário se faz a revisão da aplicação do Direito levando-se em consideração a dignidade humana e a afetividade. Os princípios constitucionais da igualdade e da dignidade da pessoa humana segregaram a desigualdade de tratamento entre os filhos, independentemente de o parentesco ser natural, civil ou afetivo. Diante de tais mudanças o presente trabalho tem o intento de demonstrar que a paternidade vai além dos elos biológicos e por fim demonstrar a relevância da possibilidade de reconhecimento da paternidade socioafetiva e seus efeitos no Direito das Sucessões. |
| Abstract: | The present work concerning the rights and duties coming from the recognition of paternity, argue about of succession effects that arise from the recognition of paternity and the legal treatment given to the person's children. The problematic topic is the treatment of affective son ahead to biological children. The Civil Code of 1916 has protects the acknowledgment of paternity, but with restrictions. When, however, goes into effect, the Federal Constitution of 1988, new principles have become guidelines for the creation of laws that best fit the social trends then begins to realize the affection based on family relationships, thus allowing for decisions adequate to reality, it's necessary to review the application of law by taking into account human dignity and affection. Constitutional principles of equality and human dignity segregated unequal treatment among children, regardless of the relationship to be natural, civil or affective. Given these changes the present work has the purpose of demonstrating that parenting goes beyond the biological linkages and finally demonstrate the relevance of the possibility of recognition of affective paternity and its effects on the Law of Succession. |
