| Summary: | A presente monografia tem como objetivo analisar a possibilidade da multiparentalidade e seus efeitos no ordenamento jurídico, a partir do estudo dos conceitos e origens da família e filiação, pelo método dedutivo. Com efeito, a família sofreu ao longo do tempo as mais diversas mudanças, de forma que a legislação no âmbito do Direito de Família acompanhou essas mudanças. Nesse sentido, a composição da família e sua estrutura sofreram mutações incluindo o instituto da filiação. A paternidade socioafetiva decorre dessas mudanças, recebendo a mesma proteção constitucional da paternidade biológica, respaldada pelo valor atribuído à afetividade nas relações familiares. Dentro desse contexto, pendem no âmbito do Poder Judiciário conflitos existentes entre a paternidade biológica e a socioafetiva, cabendo ao magistrado na prestação jurisdicional estabelecer qual a melhor solução para esse conflito. Neste viés, surge o instituto da multiparentalidade a fim de solucionar o presente impasse jurídico, devendo ser observados os princípios da dignidade da pessoa humana e o melhor interesse da criança e adolescente, e os efeitos do vínculo de parentesco. |
| Abstract: | This thesis aims to analyze the possibility of multiparentalidade and its effects on the legal system, from the study of the concepts and origins of the family and membership, the deductive method. Indeed, the family suffered over time the various changes, so that legislation in the Family Law accompanied these changes. In this sense, family composition and structure mutated including membership of the institute. The socio-affective paternity arises these changes, getting the same constitutional protection of biological parenthood, backed by the value assigned to the affection in family relationships. In this context, hang under the Judiciary conflicts between biological and socio-affective paternity, leaving the judge in adjudication establish the best solution to this conflict. This bias, the multiparentalidade Institute to resolve this legal impasse arises, observing the principles of human dignity and best interests of children and adolescents, and the effects of family relationship. |
