| Summary: | A adoção é dos institutos mais antigos presente na maioria dos ordenamentos jurídicos mundiais. Encontramos resquícios deste instituto nas primeiras civilizações habitantes da terra. Porém, diante de uma sociedade ainda muito conservadora e religiosa, encontramos dificuldade em garantir o direito uma determinada classe. O presente trabalho traz a adoção homoparental e a situação atual da possibilidade da concessão da habitação no cadastro nacional brasileiro de adoção. Não havendo nenhuma legislação reguladora para esta modalidade de adoção. Visto que, não existe vedação, trataremos do assunto com base nas normas atuais, decisões e jurisprudências. Também fazendo um comparativo com outras legislações estrangeiras. Ainda, falaremos da decisão unânime, proferida pelo STF, que servirá para os próximos casos. |
| Abstract: | Adoption is the oldest institutes present in most of the world's legal systems. We find traces of this institute in the early civilizations inhabitants of the land. However, faced with a society still very conservative and religious, we find it difficult to guarantee the right a particular class. This work brings homoparental adoption and the current situation of the possibility of granting housing in the Brazilian national register of adoption. If there is no regulatory legislation for this type of adoption. Since, there is no fence, the subject will deal based on current regulations, decisions and jurisprudence. Also making a comparison with other foreign laws. Still, talk of a unanimous decision handed down by the Supreme Court, which will serve for the next case. |
