| Title: | Análise da positivação dos direitos humanos à luz do embate ideológico ocidental durante a Segunda Guerra Mundial |

| Summary: | O presente trabalho relata a construção histórica do ideal liberal-democrático ocidental no século XIX, bem como o surgimento do regime nazista à luz dos acontecimentos após a Primeira Guerra Mundial no início do século XX. Com vistas a analisar a Segunda Guerra Mundial sob a ótica do conflito ideológico, a pesquisa relata as atrocidades cometidas durante a guerra em nome do nazismo, que construiu um ideal de grandiosidade, de purificação, de supremacia. Por meio do desenrolar da guerra e todas as violações à integridade humana, busca-se a compreensão do impacto do holocausto sobre o direito internacional. A partir dos julgamentos do Tribunal de Nuremberg há um avanço rumo à positivação dos Direitos Humanos em caráter universal que se faz representar na Declaração Universal dos Direitos Humanos das Nações Unidas em 1948 como um esforço e comprometimento mundial em prol da proteção e defesa da dignidade humana. |
| Abstract: | The present paper describes the historical construction of the western liberal-democratic ideal in the nineteenth century and the rise of the Nazi regime under the light of the events after the First World War in the early twentieth century. In order to analyse the World War II from the perspective of an ideological conflict, the following research reports the atrocities committed during the war in the name of Nazism, based on an ideal of greatness, purification and supremacy. Regarding the course of the war and all violations of human integrity committed in that time, this research aims the understanding of the impact of the Holocaust on international law. From the judgments of the Court of Nuremberg is possible to identify a progress towards the affirmation of Human Rights in universal character, represented in the Universal Declaration of Human Rights by United Nations in 1948 as an effort and global commitment towards the protection and defence of human dignity. |
